Ohio — Contractor Lien Waiver Resources
Ohio’s mechanic’s lien chapter prescribes no waiver form — but for residential work it contains a paid-in-full rule that decides real disputes. If you do home construction in Ohio, § 1311.011 is the section that should shape how you paper a job.
What the official source states
Official source: Rev. Code Chapter 1311 (esp. § 1311.011) — http://codes.ohio.gov/ohio-revised-code/chapter-1311
- Chapter 1311 prescribes no mechanic’s lien waiver form. (The chapter’s waiver provisions cover home construction contracts, § 1311.011, and employee liens, § 1311.35.)
- On a home construction or home purchase contract, if the owner paid the original contractor in full before receiving a copy of an affidavit of mechanic’s lien, no subcontractor, material supplier or laborer has a lien for that work (§ 1311.011(B)(1)).
- An owner, part owner, lessee or lending institution may make payment jointly to the original contractor and a subcontractor, supplier or laborer as a condition to their giving lien releases (§ 1311.011(B)(7)).

What this means for your paperwork
- On Ohio residential jobs, your protection is speed and paper: serve and keep proof of every notice and affidavit, because the owner’s full payment to the GC can cut off lien rights.
- Track who has been paid on the job in your payment tracker — the (B)(1) rule turns on payment facts, not intentions.
- Because there is no state form, any waiver you are handed is a private document: read every line, and keep the signed copy with the payment record.
